This indenture witnesses that BSH DEVELOPMENT CO., LLC, an Indiana liability company, is The owner of all lots and land comprising the recorded subdivision known as EAGLE CORSSING NORTH SUBDIVISION (which is represented by Bart Schutz as manage of BSH Development Co., LLC), as per plat thereof, recorded in plat Q on page 70 in the office of the Recorder of Vanderburgh County, Indiana, and does hereby make and adopt the following restrictions, reservations and conditions for the use and occupancy of the lots and lands comprising Eagle Crossing North Subdivision, which covenants, conditions, reservations and restrictions shall run with the land and shall Be binding upon all owners of lots and lands in said Eagle Crossing North Subdivision, to wit: 1. RESIDENTIAL LAND USE: All lots in Eagle Crossing North Subdivision shall be known and described and used only for single-family residential purposes. Other use of any lots or building in this subdivision shall be in violation of the Vanderburgh County Zoning Code. There shall be no permitted Use group 2 home occupations in any of the single-family residential structures, as said Use group home occupation is defined in the Vanderburgh County Zoning Code and is from time to time amended. 2. LOTS 1 AND 91: Lots 1 and 91 are to follow the Restrictions of sections 3a and 3b (Eagle Crossing Subdivision Lots 85 through 180) and only fallow as recorded on Feb. 13, 1998. This document is located in the MISC. DRAWER 5 CARD 4004 at the office of the Recorder of Vanderburgh County, Indiana. 3. TYPE OF PERMITTED STRUCTURE: No structure shall be erected, altered, placed or permitted to remain on any lot other than one (1) single-family dwelling, not to exceed two (2) stories in height, not including basements or walk-out basements, and attached garage for not less than two (2) cars (480 sq. ft. minimum) nor more than three (cars). In addition, no detached accessory building, such as a yard barn, may be erected on any lot. A;; satellite dishes, swing sets and play areas shall be placed in the back yards and shall be obscured from view from adjacent properties and streets by using shrubs or approved fencing.
